Terms of Service & Terms of Sale (MechStress)

1. Parties

These Terms are between you (“Customer”, “you”) and MechStress (“we”, “us”).

MechStress is operated by the website operator identified in our Impressum / Legal Notice (the “Operator”), which forms part of these Terms by reference.

2. Product and access duration

When you purchase MechStress, you receive access to the MechStress course/member area for 12 months (365 days) starting on the purchase date.

There is no automatic renewal. Access expires automatically unless you purchase again.

3. Account use

Access is personal and non-transferable. You must keep login credentials confidential. You are responsible for activity under your account.

4. Prices and VAT (Kleinunternehmer)

Prices are shown in EUR unless stated otherwise. 

In Germany, we apply § 19 UStG (Kleinunternehmerregelung), meaning no German VAT is charged where this rule applies. If you purchase from another country, local rules for digital services may require VAT/GST/sales tax in your jurisdiction. If required, this will be calculated and displayed at checkout.

5. Payment processing

Payments are processed by Stripe. We do not store full payment card data. If payment fails or is reversed (chargeback), we may suspend access until resolved.

6. Refund policy

Refunds are provided only in cases of technical issues that:

  1. prevent you from accessing the purchased content, and

  2. we cannot resolve within a reasonable time after you contact us at info@mechstress.com.

No refunds are granted for:

lack of usage, change of mind, or insufficient time or issues caused by your device, internet connection, or browser settings (unless clearly attributable to our platform).

7. EU/EEA right of withdrawal (digital content)

If you are a consumer in the EU/EEA, you may have a statutory 14-day right of withdrawal for distance contracts.

However, for digital content/services, your withdrawal right can be lost once performance begins if you:

  • request immediate access/performance, and

  • acknowledge that you thereby lose your right of withdrawal once performance begins.

8. License and intellectual property (no redistribution)

All course materials (including videos, audio, text, images, PDFs, exercises, solution methods, and any downloadable or viewable files) are protected by intellectual property laws and remain the property of MechStress and its Operator (as identified in the Impressum / Legal Notice).

We grant you a limited, revocable, personal, non-exclusive, non-transferable license to access and use the materials only for your own private study during your access period. 

​​Strict prohibitions (no redistribution)

You must not, and you must not allow any third party to:

  • share, sell, rent, lend, gift, or transfer your account or access;

  • share login details or allow multiple people to use one purchase;

  • reproduce, copy, download, screen-record, screen-shot, capture, photograph, scrape, or otherwise extract course materials (in whole or in part);

  • upload, publish, repost, transmit, or distribute any materials on any platform, publicly, or privately (including Discord/WhatsApp/Telegram/email/cloud drives);

  • create derivative works, summaries, “solution sheets,” re-edits, translations, or competing products based on the materials for distribution or commercial use.

​​Enforcement

We may use reasonable technical measures (e.g., watermarking, access logs) to protect content. If we reasonably suspect a violation, we may:

immediately suspend or terminate your access without notice, refuse future purchases, request removal of redistributed content, and/or pursue legal remedies and damages where appropriate.

No refund will be provided if access is suspended or terminated due to a violation of this Section.

9. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted access. We may update content, features, or the platform. Material changes that reduce access unfairly will be handled reasonably.

10. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential damages.

  • Our total liability for any claim is limited to the amount you paid for the access period in question.

Nothing in these Terms limits liability where such limitation is prohibited by law (e.g., intent, gross negligence, or mandatory consumer protections).

11. Educational content disclaimer (no guarantee of accuracy)

The content is provided for educational purposes only. We make reasonable efforts to prepare high-quality explanations and examples. However, the course materials may contain errors, omissions, simplifications, or differences in notation and methods compared to your instructor or exam. We therefore do not guarantee that the content is complete, error-free, or suitable for any specific exam, course, syllabus, use case or learning objective. Our materials are intended to support your own studying and practice, they are not a substitute for attending classes, doing independent study, or following your university’s official syllabus and instructions.

You are responsible for verifying results and using the materials appropriately. To the maximum extent permitted by law, we are not liable for outcomes based on reliance on the materials (e.g., study, exam, or academic outcomes including grades), decisions or actions taken based on the content, and incorrect or incomplete information in the materials. This disclaimer does not exclude liability where exclusion is not permitted by law (including intentional misconduct or gross negligence).

12. Governing law and jurisdiction

German law applies, excluding conflict-of-law rules, unless mandatory consumer protection laws of your country of residence apply (EU/EEA consumers).
